Terms of Service

The terms under which you may use our website and services.

These Terms of Service ("Terms") govern your use of thedistanceproject.org and any services offered by The Distance Project ("TDP," "we," "our," or "us"). By using our site or any of our services, you agree to these Terms. If you do not agree, please do not use our site.

About TDP

The Distance Project is a Michigan nonprofit organization with 501(c)(3) tax-exempt status pending. We support student-athletes in Track & Field, Cross Country, and youth running.

Using our site

You may browse, donate, apply for support, volunteer, or contact us through this site. You agree to use the site lawfully and to provide truthful information in any form you submit. You may not:

  • Submit false or misleading information in applications or donation forms
  • Attempt to access non-public parts of the site without authorization
  • Interfere with the operation or security of the site
  • Use the site to harass, defame, or harm any person or organization
  • Use automated tools to scrape or extract data without our written permission

Donations

Donations to TDP are voluntary, tax-deductible to the extent allowed by law, and final. We do not generally issue refunds. If you believe a donation was made in error, contact us at info@thedistanceproject.org within 30 days and we will work with you in good faith.

Recurring donations continue until you cancel them. You may cancel at any time through the donor portal or by contacting us. Cancellation takes effect for future charges only and does not refund prior donations. We acknowledge donations promptly and issue annual giving statements in January. If you do not receive a receipt within 24 hours of donating, please check your spam folder and then contact us.

Applications for support

Applying for athlete support does not guarantee that support will be provided. We review applications based on need, available resources, alignment with our mission, and other factors. Decisions are at our sole discretion. We do not discriminate based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic.

If your application is approved, the form, amount, and timing of support are determined by us. We may provide support directly (for example, by purchasing shoes for an athlete) or by reimbursement. Applicants and beneficiaries agree to use any support received for the purpose described in their application and to provide reasonable updates on outcomes when requested.

Intellectual property

The Distance Project name, logo, branding, and the content on this site (text, images, code) are owned by TDP and protected by copyright and trademark laws. You may not use our name, logo, or branded materials without our written permission, except for personal, non-commercial fair use (such as sharing a link to our site).

User-submitted content (application statements, contact messages, etc.) remains your property, but you grant us a non-exclusive, royalty-free license to use it for our charitable purposes, including reviewing applications, internal records, and (with appropriate anonymization or permission) impact reporting.

Third-party services

Our site uses third-party services including Stripe for payment processing and InMotion Hosting for hosting. Use of those services is also governed by their own terms and privacy policies.

Disclaimers

We provide our site and services "as is" and without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or that any defects will be corrected. Use of the site is at your own risk.

Limitation of liability

To the maximum extent permitted by law, TDP and its directors, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our services. Our total liability for any claim arising out of these Terms or your use of the site is limited to $100.

Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of our site will be brought exclusively in the state or federal courts located in Michigan.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Continued use of the site after changes constitutes acceptance.
